California passed AB 587 in 2022, a law that requires social media platforms to document their content moderation efforts, prompting X to launch a First Amendment challenge in court.

According to The Verge, US District Judge William Shubb denied the company’s request for a preliminary injunction.

“While the reporting requirement does appear to place a substantial compliance burden on social medial companies, it does not appear that the requirement is unjustified or unduly burdensome within the context of First Amendment law,” Judge Shubb wrote in his decision.

“The reports required by AB 587 are purely factual. The reporting requirement merely requires social media companies to identify their existing content moderation policies, if any, related to the specified categories,” Judge Shubb continued. “The required disclosures are also uncontroversial. The mere fact that the reports may be ‘tied in some way to a controversial issue’ does not make the reports themselves controversial.”

“These changes only impact third-party messaging vendors that send unlawful or unallowed commercial mass messaging campaigns for other businesses. The vendors will be fined if the content they are sending does not meet the standards in our code of conduct, which is in place to protect consumers from illegal or illicit content and aligns to federal and state laws.” T-Mobile said in a statement sent to the outlet.

The news was first revealed on a Vonage support page:

T-Mobile just notified Vonage that they will be implementing a new set of non-compliance fines for messaging traffic violations on all mobile channels that transverse their network (SMS and MMS Short Codes, Toll-Free Numbers and 10DLC).

Those new fines will start being applied from January 1st, 2024.

“If the employee does not demonstrate immediate and sustained attendance after the first conversation, managers should then conduct a follow-up discussion within a reasonable time frame (depending on the employee situation, ~1-2 weeks). This conversation will 1) reinforce that return to office 3+ days a week is a requirement of their job, and 2) explain that continued non-compliance without a legitimate reason may lead to disciplinary action, up to and including termination of your employment,” the guidelines said.

The new guidelines are a major escalation for the company amid its efforts to force employees back to the office. Amazon executives have been among the most vocal in their RTO push, angering employees who accuse the company of reneging on previous promises. In some cases employees moved to other parts of the country on the assurance their role would remain remote permanently, only to now be asked to move to a location near corporate offices.

Adding to the frustration is the lack of evidence cited for Amazon’s RTO push. Executives, including CEO Andy Jassy, have admitted there is no real data to support the push and credited ‘judgement calls’ instead.

Chinese companies are required by law to support Beijing when called upon, including to facilitate China’s espionage efforts. Huawei, ZTE, and others have already been subjected to stiff sanctions by multiple countries because their activities on behalf of Beijing have been labeled a threat to national security.

The satellite was end-of-life requiring it be moved to a “disposal orbit.” Dish evidently failed to take the appropriate action, resulting in the fine.

Specifically, DISH disposed of the EchoStar-7 satellite at 122 kilometers (km) above its operational geostationary orbit, short of the 300 km above its operational geostationary orbit specified in its orbital debris mitigation plan in DISH’s license. Orbital debris in space jeopardizes the nation’s terrestrial and space-based communication systems by increasing the risk of damage to satellite communications systems. Therefore, it is important for the Commission to ensure that satellite licensees meet post-mission disposal requirements in a manner compliant with their authorizations. To settle this matter, DISH admits that it failed to operate the EchoStar-7 satellite in accordance with its authorization, will implement a compliance plan, and will pay a $150,000 civil penalty.

Space junk is a growing problem and the FCC is clearly signaling that companies must start doing their part to address the problem.

“As satellite operations become more prevalent and the space economy accelerates, we must be certain that operators comply with their commitments,” said Enforcement Bureau Chief Loyaan A. X has faced ongoing allegations that there has been a significant rise in misinformation and hate speech since Elon Musk took over and gutted the content moderation and safety teams. Musk has continually denied the claims, but he appears to be taking a different tack:

If no one can report it, it must not be happening.

Research firm Reset.Tech Australia was the first to notice the change and has sent a letter to Angus Keene, X Managing Director of Australia and New Zealand:

We write to report our urgent concerns about the ability for users to report electoral misinformation on your platform. There now appears to be no channel to report electoral misinformation when discovered on your platform. We do not believe the loss of this feature is limited to Reset.Tech, rather, we believe all Australians are affected. We know of five separate individuals across Australia who have looked and are unable to report electoral misinformation. We believe this change occurred in the last week or two.

It is extremely concerning that Australians would lose the ability to report serious misinformation weeks away from a major referendum.

A recent change to your reporting process appears to have left Australian users unable to report electoral misinformation. This is because the categories for reporting in Australia offer no option to report electoral misinformation. Users are offered inappropriate categories such as hate speech, abuse, spam, imitation etc. Previously Australian users could select ‘It’s misleading’ about ‘Politics’ category. This may leave violative content subject to an inappropriate review process and not labelled or removed in compliance with your policies.

It remains to be seen if Reset.Tech Australia’s concerns will make any more headway than anyone else’s.

According to the DOJ, eBay has sold hundreds of thousands of products that violate environmental regulations. In addition, the platform is accused of selling, or contributed to the sale, of 343,000 “defeat devices” designed to circumvent vehicle emission controls.

The DOJ says eBay was also involved in the sale of at least 23,000 pesticides that were restricted, misbranded, or unregistered, even doing so in violation of a previous EPA order to stop.

The company is also accused of distributing more than 5,600 items that violate the TSCA Methylene Chloride Rule.

“Laws that prohibit selling products that can severely harm human health and the environment apply to e-commerce retailers like eBay just as they do to brick-and-mortar stores,” said Assistant Attorney General Todd Kim of the Justice Department’s Environment and Natural Resources Division (ENRD). “We are committed to preventing the unlawful sale and distribution of emissions-defeating devices and dangerous chemicals that, if used improperly, can lead to dire consequences for individuals and communities.”

“Our nation’s environmental laws protect public health and the environment by prohibiting the unlawful sale of defeat devices; unregistered, misbranded and restricted use pesticides; and unsafe products containing toxic chemicals such as methylene chloride,” said Assistant Administrator David M. Uhlmann of the EPA’s Office of Enforcement and Compliance Assurance. “The complaint filed today demonstrates that EPA will hold online retailers responsible for the unlawful sale of products on their websites that can harm consumers and the environment.”

“eBay’s sale of emission control defeat devices, pesticides and other unsafe products poses unacceptable risks to our communities disproportionately impacted by environmental and health hazards,” said U.S. Attorney Breon Peace for the Eastern District of New York. “Together with our partners, this office will vigorously enforce federal law against those whose conduct endangers public health and the environment.”
